Welcome to Des Moines Photo Booth Company LLC. By using our services, you agree to comply with and be bound by the following terms and conditions. Please read these Terms of Service carefully before using our photo booth services.

1. Acceptance of Terms

By accessing or using the services provided by Des Moines Photo Booth Company LLC (hereinafter referred to as "the Company," "we," "us," or "our"), you agree to be bound by these Terms of Service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws.

2. Services Description

The Company provides photo booth rental services for various events in the Des Moines, Iowa area. Our services include setup, operation, and takedown of photo booth equipment, as well as the provision of digital and/or printed photographs.

3. Booking and Payments

3.1. Reservations are confirmed upon receipt of a signed contract and the required deposit.

3.2. Full payment is due [30] days prior to the event date.

3.3. Cancellations made more than 30 days before the event date are eligible for a full refund of the deposit. Cancellations made within 30 days of the event date forfeit the deposit.

4. Event Logistics

4.1. The client is responsible for providing an appropriate space for the photo booth setup, including a level surface and access to a power outlet.

4.2. The Company reserves the right to refuse service if the venue conditions are deemed unsafe or unsuitable for equipment operation.
 

5. Photo Usage and Rights

5.1. By using our services, you grant the Company the right to capture, store, and process images taken during your event.

5.2. The Company retains the copyright to all images produced by our photo booths.

5.3. You grant the Company permission to use photos for marketing and promotional purposes, unless otherwise specified in writing.

5.4. Clients and their guests may use the photos for personal, non-commercial purposes.

6. Privacy Policy

6.1. We collect and store personal information, including names and email addresses, solely for the purpose of providing our services and communicating with clients.

6.2. We do not sell or share personal information with third parties, except as required by law or with your explicit consent.

6.3. Photos taken during events are stored securely and are available for download by the client for a period of 30 days after the event.

7. Liability and Damage

7.1. The Company is not liable for any injury or damage caused by guests using the photo booth equipment.

7.2. The client assumes responsibility for any damage to the equipment caused by event guests, excluding normal wear and tear.

8. Service Availability and Quality

8.1. While we strive to provide uninterrupted service, we cannot guarantee against equipment failure or other unforeseen circumstances.

8.2. In the event of equipment failure, our liability is limited to a pro-rated refund of the rental fee for the period the photo booth was inoperable.
 

9. Indemnification

You agree to indemnify and hold Des Moines Photo Booth Company LLC, its affiliates, officers, agents, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorney's fees, made by any third party due to or arising out of your use of our services.

10. Modifications to Terms of Service

We reserve the right to modify these Terms of Service at any time. We will notify clients of any significant changes. Your continued use of our services after such modifications constitutes your acceptance of the updated terms.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Iowa, without regard to its conflict of law provisions.
